There are no protections for Smith under Texas law that she did not get. According to her own litigation she was simply not happy with what the law provided. Nothing in that case indicates it is about whether people like her or not. You are right that there are constitutional rights at issue but it is whether the state court judgment will be afforded comity as required in the full faith and credit clause.

While everyone may hold strong opinions regarding the individuals involved in these legal messes, we must also consider the consequences of them as well. It is easy to sit behind a computer screen and scream guilty but we must remember that constitutional rights are on the line. Whether Anna Nicole Smith married her husband for money is not the issue at hand. They were married. Mr. Marshall made his choice to have her as his wife. With that choice came some protections for her. If we judge her as unworthy, we are setting a precedent for probate cases across the country that allow people to be shut out because we simply do not like them. I don't want to be in a courtroom that functions that way.

Anna Nicole was nasty gold-digger who married a rich man aged 90 on his death bed. She was also a drug addict. According to Larry Birkhead's testimony at the inquest, Anna Nicole gave Ecstasy and Methadone to her son Daniel Smith. Daniel later died of a drug overdose. I can't respect a mother who gave drugs to her son!
Could take years for the Marshall estate to be settled- that's an understatment. HKS and friends have been using every slimy legal trick in the book to get at his money for YEARS. At the rate the 9th Circuit is going + the rate at which HKS tends to file new lawsuits, this case could still be going on in 2020. Ah, what an efficent use of the American judicial system!
